The Pennsylvania criminal justice system operates differently depending on whether you are in Philadelphia County or the other Counties of the Commonwealth.  In Philadelphia County, criminal defendants will often find themselves in Philadelphia Municipal Court. The Philadelphia Municipal court is a court with jurisdiction over cases that are punishable by up to five (5) years in jail as well as all other cases at the preliminary hearing level.

Criminal defendants outside of Philadelphia County will often be advised by their attorney to waive their preliminary hearing in exchange for some benefit. Frequently, in counties outside of Philadelphia, the preliminary hearing will be waived in exchange for a reduction in bail or reduction in charges. Criminal defendants in Philadelphia will rarely waive their preliminary hearing and will almost always demand that a preliminary be held.
